Terms of Use
Effective: October 2, 2026
Version: terms-v1
Plain-English Summary
House DNA is a digital tool that helps homeowners organize information about a home, including rooms, equipment, maintenance, improvements, documents, photographs, warranties, records and property history.
You are responsible for the information you enter, upload, maintain, classify and choose to share. House DNA does not independently inspect a property or verify the accuracy, completeness, authenticity or legal sufficiency of homeowner-provided information.
House DNA is not a title company, escrow company, real-estate brokerage, home inspector, appraiser, lender, insurer, warranty company, engineering service, governmental record system or law firm. It is not a substitute for professional advice or official records.
House DNA also depends upon independent third-party technology providers. Availability of those services is outside the complete control of the House DNA developer or operator.
You should maintain your own independent copies of important records. House DNA is not intended to be your sole backup or permanent archival system.
The sections below contain the complete Terms of Use. If there is a conflict between this summary and the complete Terms, the complete Terms control.
1. Acceptance of These Terms
These Terms of Use ("Terms") govern access to and use of House DNA, including its website, applications, features, property records, Home Passport, ownership-transfer features and related services (collectively, the "Service").
By creating an account, affirmatively accepting these Terms, or continuing to use the Service after legally effective notice of updated Terms when acceptance is required, you agree to be bound by these Terms and the applicable Privacy Policy.
If you do not agree, do not create an account or use the Service.
2. Eligibility and Account Responsibility
You may use House DNA only if you are legally capable of entering into a binding agreement and your use is permitted by applicable law.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account. You must provide reasonably accurate account information and must not knowingly impersonate another person or falsely represent your authority concerning a property.
You are responsible for protecting access to your email account and devices because those systems may be used for authentication, password recovery or other security-sensitive functions.
3. Purpose of House DNA
House DNA provides tools for organizing, storing, displaying and transferring certain digital information associated with a residential property.
The Service may allow users to record information about property systems, appliances, rooms, finishes, maintenance, repairs, improvements, warranties, photographs, documents and other property-related information.
House DNA is an information-management platform. The presence of information in House DNA does not make that information an official public record, legal record, certified record or independently verified statement.
4. User Responsibility for Property Information
You are solely responsible for information and content that you enter, upload, import, describe, classify, maintain, disclose, share or transfer through the Service.
This responsibility includes determining whether information is accurate, current, complete, lawful, appropriate to store, appropriate to disclose and appropriate to designate as transferable with a property.
House DNA does not guarantee the accuracy, completeness, authenticity, condition, provenance, ownership, legality or reliability of information supplied by users.
You should independently verify information before relying upon it for purchasing, selling, repairing, maintaining, financing, insuring, valuing or otherwise making decisions concerning real property.
5. User Content and Uploads
"User Content" includes documents, photographs, descriptions, serial numbers, maintenance records, receipts, warranties, property information and other materials submitted through your account.
You retain any ownership rights you lawfully possess in your User Content.
By submitting User Content, you grant House DNA and service providers acting on its behalf a non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, reproduce and display that content only as reasonably necessary to operate, secure, maintain, improve and provide the Service and the features you request.
You represent that you have the rights, permissions or other lawful authority necessary to submit and use the content through House DNA.
6. Sensitive and Private Information
You are responsible for deciding what information you place in House DNA. Do not upload information that you are not legally permitted to possess, store or disclose.
Users should avoid placing unnecessary highly sensitive information in property records, including passwords, financial-account credentials, Social Security numbers or other information that is not needed for legitimate property documentation.
Where House DNA provides privacy or transferability classifications, those tools assist you in organizing information but do not replace your responsibility for reviewing what you choose to disclose.
7. Home Passport
A Home Passport is a user-controlled presentation of selected property information. The homeowner or authorized user is responsible for reviewing and selecting information designated for inclusion.
House DNA does not independently certify, inspect or verify information appearing in a Home Passport.
A Home Passport is not a home inspection, seller disclosure statement, appraisal, title report, certification, warranty, guarantee of property condition or substitute for legally required disclosures.
Anyone receiving a Home Passport should independently investigate and verify information material to their decisions.
8. Transfer of House DNA Records
House DNA may permit an authorized user to transfer stewardship of a digital property record to another House DNA account.
A House DNA transfer does not transfer legal ownership of real estate.
A House DNA transfer does not convey title, create or record a deed, establish legal ownership, perform escrow, verify a closing, establish the validity of a real-estate transaction or replace official county, state or other governmental property records.
The parties to a property transaction remain responsible for determining that the actual real-estate transaction, closing and legal transfer of ownership have been properly completed.
House DNA may require separate confirmations from the transferring and receiving users before digital stewardship is changed. Those confirmations concern only administration of the House DNA digital record.
9. No Professional Services or Advice
House DNA and its developer/operator do not act through the Service as a real-estate broker or agent, title company, escrow provider, attorney, accountant, appraiser, home inspector, engineer, architect, contractor, lender, insurer, warranty provider or governmental authority.
Information presented through House DNA is for organizational and informational purposes and should not be interpreted as legal, financial, tax, engineering, construction, safety, insurance, inspection or other professional advice.
Users should consult appropriately qualified professionals when professional advice or verification is required.
10. No Guarantee of Property Condition
The existence or absence of a record in House DNA does not establish the condition, safety, quality, compliance, remaining useful life or suitability of a home, system, appliance, component, repair or improvement.
Maintenance records do not guarantee that maintenance was properly performed. Equipment information does not guarantee that equipment is operational or safe. Documents and photographs do not guarantee current property condition.
11. Third-Party Hosting, Infrastructure and Services
House DNA relies on independent third-party technology providers and infrastructure. These may include web hosting and deployment providers, source-code and development platforms, database providers, cloud storage providers, authentication providers, domain and DNS providers, internet service providers, telecommunications networks, software libraries and other technology vendors.
Third-party services used in connection with House DNA may include services provided by companies such as GitHub, Netlify and Supabase, as well as other providers that may be added, replaced or removed over time.
These providers are independently operated. House DNA and its developer/operator do not control their continued availability, policies, pricing, security, technical operation, business decisions, data-retention practices, suspension decisions or continued existence.
A third-party provider may experience an outage, security incident, technical failure, policy change, suspension, restriction, termination or permanent discontinuation. A provider may also suspend or terminate services used by House DNA under its own policies or contractual rights.
Such events may be outside the reasonable control of the House DNA developer/operator and may make some or all of the Service temporarily or permanently unavailable.
12. Internet and Network Availability
House DNA is an internet-based service. Its operation depends on networks, devices, browsers, telecommunications systems and other infrastructure that may be outside House DNA's control.
House DNA does not guarantee continuous connectivity, uninterrupted access, error-free operation or compatibility with every device, browser, operating system or network.
13. Service Changes, Suspension and Discontinuation
To the maximum extent permitted by applicable law, the House DNA developer/operator may modify, restrict, suspend, replace, reset or discontinue any feature or all of the Service, temporarily or permanently, at any time.
This includes discontinuation of the free pilot, discontinuation of House DNA itself, changes required because of third-party providers, security concerns, technical limitations, legal requirements, business decisions or circumstances beyond the developer/operator's reasonable control.
Where reasonably practicable, House DNA may attempt to provide notice of a planned permanent shutdown, but advance notice or continued access cannot be guaranteed.
No provision of these Terms creates a right to perpetual operation, perpetual hosting, continued availability of any feature or indefinite storage of User Content.
14. User Backup Responsibility and Risk of Data Loss
House DNA must not be treated as the sole repository or backup for important or irreplaceable information.
Users are responsible for maintaining independent copies of documents, photographs, receipts, warranties, maintenance information and other records they consider important or are legally required to retain.
Information may become unavailable or may be lost, deleted, corrupted, damaged or unrecoverable because of hardware or software failure, third-party service interruption, account problems, cyber incidents, programming errors, user actions, service discontinuation or other causes.
House DNA does not guarantee that any particular item of User Content can always be recovered, restored or exported.
15. Security
House DNA may use technical and organizational measures intended to help protect information. However, no internet-connected service, database, storage system or transmission method can be guaranteed to be completely secure.
You acknowledge that use of an online service involves inherent security and availability risks.
You are responsible for using reasonable safeguards for your own account, devices, email account and credentials.
16. Acceptable Use
You may not use House DNA to:
- violate applicable law or the legal rights of another person;
- knowingly submit fraudulent, deceptive or unlawful information;
- upload content you do not have the right to use;
- attempt unauthorized access to another account, property or system;
- interfere with, damage, overload or circumvent security of the Service;
- introduce malicious software or harmful code;
- scrape, probe, reverse engineer or exploit the Service except where applicable law expressly permits such activity; or
- use House DNA to facilitate fraud, identity theft or other unlawful activity.
17. Intellectual Property
Except for User Content and third-party materials, the House DNA software, design, branding, interfaces, organization, original text, graphics and other proprietary elements are owned by or licensed to the House DNA developer/operator and are protected to the extent provided by applicable law.
These Terms provide a limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not transfer ownership of House DNA intellectual property.
18. Third-Party Content and Links
House DNA may contain links, information or integrations involving third parties. House DNA does not control and is not responsible for independent third-party websites, products, services, terms, privacy practices or content.
Use of third-party services may be governed by separate agreements between you and those providers.
19. Free Pilot
House DNA may be offered without charge during a pilot or introductory period. Free availability does not create a right to continued free service or continued availability of any particular feature.
Features, limits, availability and future pricing may change. If a future paid service is offered, applicable pricing and additional terms will be presented before a user is charged.
20. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSE DNA AND ITS DEVELOPER/OPERATOR DISCLAIM WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY AND ERROR-FREE OPERATION.
HOUSE DNA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, PERMANENT, COMPLETE, ACCURATE OR FREE FROM LOSS, DEFECTS OR HARMFUL COMPONENTS.
Nothing in these Terms excludes a warranty or right that applicable law does not permit to be excluded.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOUSE DNA AND ITS DEVELOPER/OPERATOR SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, DOCUMENTS, RECORDS, PROFITS, REVENUE, BUSINESS OPPORTUNITIES, GOODWILL OR USE, ARISING FROM OR RELATED TO THE SERVICE.
THIS LIMITATION INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOSSES ARISING FROM SERVICE OUTAGES, THIRD-PARTY PROVIDER ACTIONS, HOSTING OR NETWORK FAILURES, DATA LOSS OR CORRUPTION, USER CONTENT, PROPERTY INFORMATION, RELIANCE UPON INFORMATION, UNAUTHORIZED ACCESS, SERVICE SUSPENSION OR PERMANENT DISCONTINUATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FOR A SERVICE PROVIDED TO A USER WITHOUT CHARGE, THE AGGREGATE LIABILITY OF HOUSE DNA AND ITS DEVELOPER/OPERATOR ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT REMEDY OR DOES NOT PERMIT SUCH A LIMITATION.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, these provisions apply only to the maximum extent permitted by law.
22. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless House DNA and its developer/operator from third-party claims, liabilities, damages, judgments, losses and reasonable costs arising from your unlawful use of the Service, your User Content, your violation of these Terms, your infringement of another person's rights, or information you knowingly or improperly disclose or represent through the Service.
This provision does not require indemnification to the extent prohibited by applicable law.
23. Account Suspension and Termination
House DNA may suspend, restrict or terminate access where reasonably necessary to protect users or the Service, respond to suspected misuse or security risks, comply with law, enforce these Terms, respond to third-party infrastructure limitations or discontinue the Service.
Termination or suspension may result in loss of access to information. Users therefore remain responsible for independent backups of important records.
24. Changes to These Terms
House DNA may update these Terms as the Service, technology, legal requirements or business practices change.
Updated Terms will carry a revised effective date or version identifier. Where required by applicable law or appropriate because of a material change, House DNA may provide notice or request renewed acceptance.
25. Electronic Communications and Records
You agree that communications, notices, confirmations and records related to House DNA may be provided electronically to the extent permitted by applicable law.
You are responsible for maintaining a valid email address and equipment capable of accessing electronic communications associated with your account.
26. Governing Law
To the extent permitted by applicable law, these Terms and disputes arising from the Service will be governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Nothing in this section eliminates rights or remedies that applicable consumer law does not permit a user to waive.
27. Severability and No Waiver
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect to the extent permitted by law.
Failure to enforce a provision on one occasion does not waive the right to enforce that provision later.
28. Entire Agreement
These Terms, together with the House DNA Privacy Policy and any additional disclosures or terms presented for a specific feature, constitute the applicable agreement governing use of the Service concerning their subject matter.
29. Contact and Legal Notices
Questions concerning these Terms or the operation of House DNA may be submitted through the contact method made available by House DNA.
A dedicated support or legal contact address may be designated as the public pilot expands.
Important Reminder
House DNA helps preserve and organize a home's digital history. It does not replace your own backups, official property records, required disclosures, professional inspections or qualified professional advice.
